Fair Use, a symbol Kirk has never seen and doesn’t understand.

One of the things Kirk agreed to when he sent a DMCA takedown of my work to createspace was that he would enter into arbitration of some kind. Either we would talk or our lawyers would talk. Knowing he doesn’t have a lawyer and never will, and having had his email account blocked after I explained how badly he just broke the law, I’ve had to do a bit of a work around to send him a new message from a different account. Here is my most recent email to him.

Copyright Games

On January 27th I received this letter from Createspace:

Dear Mr. Miller,

We have received notice from a third party regarding copyright concerns over “The Infinity Strain: Part II of The Infinity Man Saga,” 4394007. Please be advised that we do not involve ourselves in third party disputes and therefore have removed the availability of the title through our systems until this matter is resolved.

Months Pass

The Infinity Strain was first published in August of 2013. While not expecting a comment from Kirk Hastings, it was however strange that when he was repeatedly made aware of this book (including having it placed next to his own on the Amazon listing) he didn’t say a peep.

I, and others, assumed he was just being more adult than we will be, and ignoring the issue completely. That turns out not to be the case. Sometime in late January he suddenly became “aware” of the book and proceeded to freak out. This was nothing new, he’d quite often taken different tactics when dealing with people he disagreed with, which almost always devolved into him spazzing out. But, it wasn’t until January 28th when Mr. Hastings proved to be something of a class-A moron and moved into internet law jockey territory.

Kirk Hastings is a Christian apologist and former podcaster who considers himself an author. He’s written quite a few self published and vanity published books, which there’s nothing wrong with. However, he is so proud of his publisher, “Publish America” that he refuses to admit that this is a scam system used to pull money from the gullible.
